As the coronavirus (Covid-19) pandemic spreads throughout the United States, many workers wonder if their Worker’s Compensation Insurance will cover them if they contract the virus. The answer to this question is, unfortunately, not a simple one.

This insurance covers employees who are injured or contract an illness while working. The specifics of what is covered varies from state to state. Still, if an employee contracts an illness or is injured while working, they are eligible for workers’ compensation benefits. Depending on your state, workers’ compensation insurance might cover you if you contracted Covid-19 in your workplace.

Which States Require Workers Compensation Insurance? 

This insurance type is not required in every state. Only four states require employers to have this type of coverage. Those states are: 

  • Wyoming 
  • Washington 
  • New Jersey 
  • North Dakota  

A few states also require certain employers to have workers’ compensation insurance. These include: 

  • Minnesota 
  • Kansas 
  • Louisiana 

In these cases, the requirement is usually based on the number of employees an employer has or the type of business. For example, Louisiana requires all businesses with five or more employees to carry workers’ compensation insurance. Meanwhile, Kansas requires any business that employs construction workers to have this type of coverage. 

Lastly, there are two states that never require business owners to get workers’ compensation insurance: 

  • Texas
  • South Dakota

If you’re not sure whether your state requires such insurance, you can check with your state’s workers compensation board or department of labor. You can also check with insurance services in your state. Generally, they will be up-to-date on the requirements for business owners in your state. 

Who Needs Workers’ Compensation Insurance In Connecticut?

 Generally, all employers in Connecticut who have one or more employees must have workers’ compensation insurance. This includes out-of-state employers who have employees working in Connecticut and public and private sector organizations. Some types of businesses are exempt from the requirement to have workers’ compensation insurance, including sole proprietorships, partnerships, and certain types of corporations.

Penalties For Not Providing Workers Compensation Insurance

If you’re an employer in the United States, you must provide workers’ compensation insurance for your employees. Failure to do so can result in some pretty hefty penalties.
